Terms & Conditions

Agreement for the Provision of Children’s Events Services in Cyprus

Effective date: 02 December 2025

BESMARTKIDS LTD, a company incorporated under the laws of the Republic of Cyprus under registration number HE455383, operating through the official website www.besmartcy.com, hereinafter referred to as the “Company” or the “Service Provider”, offers any individual or legal entity, hereinafter referred to as the “Customer”, to enter into this Agreement under the following terms and conditions.

Payment for services constitutes full and unconditional acceptance of these Terms & Conditions.

1. Subject of the Agreement

1.1. The purpose of this Agreement is the provision of services related to the organisation and delivery of educational, entertainment, interactive, and creative children’s events (the “Events”) at BeSmart children’s centres, as well as at other venues determined by the Service Provider within the Republic of Cyprus.

1.2. Events may include interactive activities, educational programmes, creative workshops, physical activities, music activities, outdoor activities, games, and other elements determined by the Service Provider.

1.3. Current schedules, programme descriptions, service prices, and contact details are available on www.besmartcy.com and the Company’s official social media channels.

2. Rights and Obligations of the Parties

2.1. Obligations of the Service Provider

The Service Provider agrees to:

2.1.1. Provide services in accordance with these Terms & Conditions, the schedule, and the selected programme.

2.1.2. Ensure a reasonable level of children’s safety during Events.

2.1.3. Provide necessary materials and equipment.

2.1.4. Comply with applicable hygiene standards, fire safety requirements, and the laws of the Republic of Cyprus.

2.1.5. Inform the Customer of any changes affecting paid Events.

2.1.6. Provide communication channels through the contact details published on the website.

2.1.7. Process personal data in accordance with GDPR requirements.

2.2. Rights of the Service Provider

The Service Provider has the right to:

2.2.1. Engage third parties to provide services.

2.2.2. Take photographs and videos during Events and use such materials for informational and marketing purposes in compliance with GDPR.

2.2.3. Refuse admission of a child showing signs of illness or behaviour that may compromise safety.

2.2.4. Modify the programme format, materials, venue, or staff members due to objective circumstances.

2.2.5. Adjust the organisation of Events in case of technical issues or other unforeseen circumstances.

2.3. Obligations of the Customer

The Customer agrees to:

2.3.1. Ensure the child attends the paid Events.

2.3.2. Transfer responsibility for the child to the Service Provider’s staff before the Event and collect the child after completion.

2.3.3. Confirm that there are no medical restrictions preventing participation.

2.3.4. Inform the Service Provider about allergies, health conditions, or special requirements.

2.3.5. Provide accurate contact information.

2.3.6. Treat the Service Provider’s property with care.

2.3.7. Compensate for any damage caused by the child.

2.3.8. Not bring a child to an Event if the child shows signs of illness.

2.3.9. Understand that if a child leaves the Event voluntarily before completion, the service fee is non-refundable.

2.4. Rights of the Customer

The Customer has the right to:

2.4.1. Receive accurate information about the services.

2.4.2. Submit feedback and suggestions.

2.4.3. Select Events based on the child’s age and availability of places.

3. Payment Terms

3.1. Payment may be made:

  • through online forms on the website;
  • in cash to a Company representative;
  • by bank card (where available);
  • via Revolut transfer;
  • through other payment methods indicated on the website.

3.2. Service prices are published on the website and include applicable taxes.

3.3. Upon completion of the services, the parties have no mutual claims unless otherwise required by applicable law.

4. Additional Terms

4.1. The Service Provider reserves the right to refuse participation if a child shows signs of illness.

4.2–4.9. The Service Provider takes reasonable measures to ensure safety but shall not be responsible for:

  • actions of a child who fails to follow instructions;
  • personal belongings;
  • technical failures;
  • weather conditions or external discomfort;
  • individual reactions to materials where relevant information was not provided in advance;
  • minor injuries occurring despite reasonable safety measures;
  • actions of third parties;
  • supervision of the child after the Event has ended.

5. Liability of the Parties

5.1. The parties’ liability is determined according to the laws of the Republic of Cyprus.

5.2. The Service Provider is not liable for failure to provide services due to circumstances beyond its reasonable control.

5.3. The Service Provider’s liability is limited to the amount paid for the relevant service.

5.4. The Customer is responsible for the child’s behaviour during participation.

5.5. The Service Provider is not liable for indirect losses.

6. Changes and Termination of the Agreement

6.1. Changes to these Terms & Conditions are published on the website at least one day before they become effective.

6.2. Cancellation notices may be sent through any available communication channel.

6.3. Refund Policy:
  • Full refund is available for cancellations made at least 10 days before the Event.
  • Later cancellations are refundable only upon presentation of a medical certificate.
  • By mutual agreement, the payment may be transferred towards other services.
  • If the Event is cancelled or significantly changed by the Service Provider, the Customer receives a full refund.

7. Personal Data Processing (GDPR)

7.1. By accepting these Terms & Conditions, the Customer agrees to the processing of personal data.

7.2. Processing may include collection, storage, organisation, and transfer where necessary for service provision.

7.3. Personal data is stored only for the period required for legitimate processing purposes.

7.5. The Privacy Policy is available on the Company’s website.

8. Final Provisions

8.1. Payment constitutes acceptance of these Terms & Conditions.

8.2. These Terms & Conditions are governed by the laws of the Republic of Cyprus.

8.3. Any disputes shall first be resolved through negotiations. If no agreement is reached, disputes shall be subject to the jurisdiction of the courts of the Republic of Cyprus.
